Innacurate estimates of costs and special circumstances under s70(3) Solicitors Act 1974

cost estimate

This was a case dealing with an application under s70(3) of the Solicitors Act 1974. A focus of the claimant’s submissions was on the inaccuracy of costs estimates it had been provided. In determining that special circumstances existed by reason of the discrepancy between the estimates provided and the costs actually billed, Master Rowley made a number observations, many of which will be just as relevant in the context of any detailed assessment hearing itself.
